This policy covers our customer facing business in the USA and applies to information we obtain:

Where that is the case, both Beauty Pie and the social media platform may be jointly responsible for personal data, and this privacy policy will apply, together with the social media platform’s policy.

This policy may change from time to time. Your continued use of this Website after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

When we use the terms ‘We’, ‘us’ and ‘our’ in this policy, we mean Beauty Pie USA Inc. and our group companies including our parent company. 

2. Types of Data We Collect

In order to provide you with a wide range of products and services, including on the BeautyPie.com website (“Website”), we will collect information about you. What we collect depends on how you interact with us. When we use the term ‘Personal Information’ we mean information that identifies, relates to, describes or can be associated with you.

We may collect and process the following personal information, including sensitive personal information, that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household:

Any job applicant information is collected in accordance with our Applicant Privacy Policy, which is provided to you separately. We only use and collect sensitive personal information for the purposes allowed by law or with your consent. We do not collect or process sensitive personal information for the purposes of building a profile about you or altering your experience outside of your current interaction with us.

3. When and How We Collect Personal Data

Information collected directly from you: This is information about you that you give us by filling in forms on our Website or by corresponding with us by phone, e-mail, video chat, text chat or otherwise. It includes information you provide when you register to use our Website, subscribe to our service, when you shop with us, participate in discussion boards, consultations, chats, webinars or other social media functions on our Website, enter a competition, promotion or survey, and when you report a problem with our Website.

Information we collect about you using online and automatic tracking technologies: information collected when you visit our Website, open our emails or interact with our ads. Includes technical information from operating systems and platforms, automated monitoring on our websites, cookies and similar technologies on our website.

Information from other sources: This is information we receive about you if you use any of the other websites we operate or the other services we provide. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, affiliate network publishers, research providers, analytics providers, search information providers, credit reference agencies and social networks). Sometimes, aggregate personal information we collect to create ‘audiences’. These ‘audiences’ may also be informed by data we receive from third parties. We undertake this activity to better personalise advertising to you.

We use cookies and similar technologies (such as pixels, web beacons, software developer kits, third–party libraries, and other similar online tracking technologies) (collectively, “online tracking technologies”) to manage and personalise your experience, analyse our traffic and personalise advertising. This helps us to provide you with a great experience when you browse our website and also allows us to improve our site.

We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf.   • Performance: Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards;

6. Third Parties Who Process Personal Data

In addition to specific situations described elsewhere in this policy and instances where we ask for your consent separately, we may disclose the above categories of personal information in the following circumstances:

  • business partners, suppliers and subcontractors: for the performance of any contract we enter into with them or you.

  • social media platforms: to provide you with a seamless experience when interacting with us or our products via social media.

  • legal process: in relation to subpoenas, warrants, court orders, government inquiries, or investigations; or to comply with relevant laws and regulations; if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our policies and other agreements; or to protect the rights, property, or safety of Beauty Pie, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

  • Change of control: In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets; if Beauty Pie or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

7. Children and Minors

Beauty Pie does not knowingly collect or solicit Personal Information from children and minors. 8. How We Secure Personal Data

We employ industry-standard security measures to protect the loss, misuse, and alteration of the information under our control. In addition, we utilize a licensed system for credit card authorization and fraud detection. We use industry standard SSL (Secure Sockets Layer) encryption to protect the confidentiality of your personal information.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

9. How Long We Keep Personal Information For

We will keep your personal information while you have an account with us or while we are providing products and services to you. Thereafter, we will keep your personal information for as long as is necessary:

  • To respond to any questions, complaints or claims made by you or on your behalf

  • To show that we treated you fairly –or–

  • To keep records required by law

10. SMS Marketing Terms

If you sign up to receive SMS marketing messages, these terms and conditions apply.

Text the keyword STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode to cancel. After texting STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our shortcode you will receive one additional message confirming that your request has been processed. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP, END, CANCEL, UNSUBSCRIBE or QUIT keyword commands and agree that Beauty Pie and its service providers will have no liability for failing to honor such requests.

If you sign up for our text messaging program, cookies may be used to personalize your experience (e.g. send you personalized text messages such as shopping cart reminders).

11. Your Privacy Rights

You have certain privacy rights which you can exercise as set out below. Please note that some of these rights may vary depending on your state of residence.

Managing communication preferences

You can unsubscribe from promotional marketing at any time by following the instructions in those messages, by clicking unsubscribe links in email communications, or by following the SMS opt-out steps set out above . You can also exercise the right at any time by contacting us at customer.service@beautypie.com.

Our Website may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

Account information

You can access, correct or delete certain information stored within your online account at any time by logging into beautypie.com and navigating to ‘My Membership’.

12. State Privacy Notice and rights

A number of states, including California, Colorado, Connecticut, Utah, and Virginia have enacted consumer privacy laws that grant their residents certain rights and require additional disclosures. These are set out below, and this section serves as our notice at collection. However note that this section applies together with the rest of our Privacy Policy.

Collection, use and disclosure of personal data

As described in our Privacy Policy, we collect, use and disclose personal data. In the last 12 months we have collected the categories of personal information set out in section 2 above. The ways we collect personal information are set out in section 3, and why we use personal information is set out in section 5 above.

Access To, Deletion and Correction of Specific Information And Data Portability

These rights apply if you are a resident of California, Colorado, Connecticut, Utah or Virginia.

Access

You have the right to request that Beauty Pie discloses certain information to you about our collection and use of your personal information. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.

  • The categories of sources for the personal information we collected about you.

  • Our business or commercial purpose for collecting or selling that personal information.

  • The categories of third parties with whom we share that personal information.

  • The specific pieces of personal information we collected about you.

  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:

    • sales, identifying the personal information categories that each category of recipient purchased; and

    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Please note that we are not required to: (A) Retain any personal information about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained (B) Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered personal information; or (C) Provide the personal information to you more than twice in a 12-month period.

Deletion

You have the right to request that Beauty Pie deletes certain of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

  • Debug products to identify and repair errors that impair existing intended functionality.

  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.

  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

  • Comply with a legal obligation.

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Correction

If we maintain inaccurate personal information about you, you have the right to request us to correct that inaccurate personal information. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.

How to exercise these rights

You can exercise the above rights by contacting us on customer.service@beautypie.com or via phone on 866-329-9580 (toll free). You may also make a verifiable consumer request on behalf of your minor child. Please note:

  • You may only make a California, and Colorado data access or data portability disclosure request twice within a 12-month period. CCPA/CPRA-related data access requests only relate to personal information collected in at least the last 12 months.

  • If you choose to contact us directly, you will need to provide us with:

    • Enough information to identify you 

    • Proof of your identity and address (e.g., a copy of your driving license or passport and a recent utility or credit card bill)

    • A description of what right you want to exercise and the information to which your request relates

  • We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person's behalf.

  • Any personal information we collect from you to verify your identity in connection with you request will be used solely for the purposes of verification.

  • You may designate an authorized agent to submit a request on your behalf. Contact us for further information on this.


Disclosure and opt-out of Personal Information Sold, Shared, or Disclosed for a Business Purpose and targeted advertising

These rights apply if you are a resident of California, Colorado, Connecticut, Utah or Virginia.

In connection with any personal information we may sell, share, or disclose to a third party for a business purpose, you have the right to know:

  • The categories of personal information about you that we sold or shared and the categories of third parties to whom the personal information was sold or shared –and–

  • The categories of personal information that we disclosed about you for a business purpose and the categories of persons to whom the personal information was disclosed for a business purpose

Categories of personal information about you that that may be considered “sold” / “shared” are: Identifiers; Information that identifies, relates to, describes, or is capable of being associated with, a particular individual; Commercial information; Internet or other electronic network activity information; Geolocation data

Categories of third parties to whom the personal information may be considered “sold”/ “shared” include advertisers and marketing partners; data analytics providers; social media networks; payment processes; logistics partners; member happiness partners; technical, anti-fraud and security partners.

We disclose personal data to third parties to promote Beauty Pie on other sites and services. Under some state laws, these could be considered “sales” “sharing” or “targeted advertising. You have the right to opt-out the use or disclosure of personal data for these purposes. To exercise these rights, visit our homepage and click on the Your Privacy Choices link.

You may also opt out of targeted advertising by certain companies that participate in third-party industry groups by visiting the Network Advertising Initiative consumer opt-out page. Please note that even if you opt out of receiving interest-based advertising, you will still receive advertisements, but they will be more general in nature.

Right to limit use of sensitive personal information

We only use and collect sensitive personal information for the purposes allowed by law or with your consent. We do not collect or process sensitive personal information for the purposes of building a profile about you or altering your experience outside of your current interaction with us.

Notice of Financial Incentives

We may provide discounts and other benefits to customers who sign up to receive our marketing emails, messages or participate in surveys. These offerings may constitute “financial incentives” under certain state privacy laws. If you decide to participate in a financial incentive, we collect personal data from you, such as identifiers (like your name and email address), commercial information (like your purchase history), and inferences (like your shopping preferences).

You can opt into a financial incentive by following the sign-up or participation instructions provided and you can opt out at any time by following the unsubscribe instructions in our promotional emails and messages  or contacting us at customer.services@beautypie.com. In some cases, we may provide additional terms and conditions, which we will provide to you when you sign up. The value of your personal data is reasonably related to the value of the offer or discount presented to you.

Non Discrimination

We will not discriminate against you for exercising any of your CCPA rights.
